Under the Tenant Fees Act 2019, letting agents and landlords in England are only permitted to charge the following fees to tenants. Any fee not listed below is prohibited.
Permitted Fees
Rent
The agreed rent payable under the tenancy agreement.
Tenancy Deposit
A refundable deposit capped at:
- 5 weeks’ rent (where annual rent is under £50,000)
- 6 weeks’ rent (where annual rent is £50,000 or more)
Holding Deposit
A refundable holding deposit to reserve a property, capped at 1 week’s rent.
Default Fees (Late Payment of Rent)
Interest may be charged on overdue rent after 14 days, capped at 3% above the Bank of England base rate.
Lost Key or Security Device Replacement
Charged only to cover the reasonable cost of replacing lost keys, fobs, or security devices (evidence of cost will be provided).
Variation of Tenancy (at the Tenant’s Request)
For changes such as adding or removing a tenant, capped at £50, or higher if reasonable costs can be demonstrated.
Early Termination (Surrender of Tenancy)
Were requested by the tenant, fees may be charged to cover the landlord’s reasonable loss or costs incurred.
Utilities, Council Tax and Other Charges
Payments for utilities, council tax, TV licence, or communication services, where applicable under the tenancy agreement.
